논문초록
이 연구는 한국의 디자인보호법에 나타난 ‘디자인’ 용어의 법적 수용과 전개 과정을 역사적으로 고찰하는 데 목적이 있다. 오늘날 한국 디자인보호법은 2005년 기존 의장법의 명칭이 변경된 것으로서, 일제강점기 시행된 일본 의장법의 명칭은 해방 후 오랜 기간 한국의 법문에 남아 있었다. 이 연구는 19세기 말 ‘design’의 번역어로 선택되어 법문에 등장한 ‘의장’이라는 용어에 집중하여 이 용어가 오늘날 한국에서 ‘디자인’의 법적 개념을 형성하는 데 어떻게 영향을 미쳤는지 그 역사적 궤적을 검토한다.

A Historical Review of the Concept of ‘Design’ as ‘Uijang (意匠)’
: Acceptance and Development of the Legal Term ‘Design’ in the Korean Design Protection Act

This study investigates the historical development and legal reception of the term ‘design’ within the context of Korea’s Design Protection Act. The current law, renamed in 2005, was previously known as ‘Uijang-beop (意匠法),’ a title inherited from Japanese law during the colonial period. This legacy illustrates how the legal terminology introduced under Japanese rule remained embedded in Korean legal system for an extended time. Focusing on the term ‘Uijang(意匠)’, which was introduced into legal discourse in the late 19th century as a translation of ‘design,’ this study traces its historical trajectory and investigates how this term has influenced the formation of the legal concept of ‘design’ in contemporary Korea.
