한국 디자인보호제도의 시작과 ‘디자인’ 개념

The Beginning of Korean Design Patent System and its concept of ‘Design’

이 연구는 '디자인'의 개념이 계속해서 확장되고 복잡해지는 가운데 오늘날 법 제도 안에서 다루어지는 '디자인' 개념은 어디에서부터 출발한 것이며, 보편적 의미의 '디자인'과는 어떠한 괴리를 갖고 있는지 살펴보는 것에 목적이 있다. 우리나라에서 실행된 초기 특허법의 형성 및 전개 과정을 살펴보고, 법 제도 안에서 사용되는 '디자인' 용어의 변화에 주목하여, 조선 시대 때 사용되던 '의장意匠'의 개념을 분석해 오늘날 디자인 개념 정의의 문제점을 파악하고자 한다.

As the concept of ‘design’ is constantly expanding and becoming complicated today, the article examines its origin of concept ‘design’ and how it has derived to the degree that is being addressed in our current law system, as well as the disjunction between ‘design’ in law and ‘design’ as a generic term. This article will be exploring the initial stage of early design patent system in Korea, and how it was formed and developed. Also, with close inspection of the term ‘uijang意匠’, which was used from Chosun era for design, will be questioned its appropriacy of the definition in regards to the term ‘design’ today.
